REGULATIONS

I. DEFINITIONS

1. Regulations – this document governing the terms and conditions of execution of the agreement for the provision of services for the organization of Training Camps.

2. Service Provider – Tomasz Szymczyk conducting business under the name Pawi-One Tomasz Szymczyk, Wyzwolenia 8c/ 24 Street, 41-103 Siemianowice Śląskie, NIP (Tax Identification Number): 8133216973, REGON (National Business Registry Number): 521359278, e-mail: info@iloverolki-iic.com, mobile phone number: +48607053741.

3. Service Recipient/Participant – entity using services of the Service Provider in the subject of participation in Training Camp.

4. Training Camp – a four-day training organized by the Service Provider for the Participants, including the improvement of skills of teaching roller skating by the Participants.

5. Parties – Provider and Participant jointly.

6. RODO – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

II. GENERAL PROVISIONS

1. Regulations define the principles for the provision of services under the contract for the organization of the Training Camp between the Participant and Service Provider.

2. The Training Camp organizer is Tomasz Szymczyk conducting business under the name Pawi-One Tomasz Szymczyk, Wyzwolenia 8c/24 Street, 41-103 Siemianowice Śląskie, Poland, Tax Identification Number (NIP): 8133216973, Register number (REGON): 521359278, e-mail: info@iloverolki-iic.com, phone number: +48607053741. The data indicated above may be used to contact the Service Provider.

3. Training participant may be any natural person from any country in the world, having full legal capacity according to the provisions of its national law, but not younger than 18 years old.

4. Training Camp is directed to healthy and physically fit people who want to improve their skating teaching skills as in the role of the skating instructor. There will be no roller skating instruction during the Training Camp for those wishing to personally learn how to roller skate. By expressing willingness to participate in the Training Camp, the participant assures that there are no health contraindications to his/her participation in the Training Camp.

5. The training camp will only take place if at least 8 participants send in an application form accepted by the Service Provider and pay the deposits on time. In case of a smaller number of participants the Training Camp will not take place and any advance payments made will be refunded.

III. APPLICATION FORM

1. A Participant applies for participation in the Training Camp by completing and submitting the application form, available at https://iloverolki-iic.com/registration/

2. In the application form the Participant is obliged to provide the following data:

  • first name and surname;
  • current place (address) of residence;
  • PESEL number or other identification number of the natural person (if possessed) or date of birth, if the natural person does not possess PESEL number;
  • nationality
  • e-mail address;
  • phone number.

3. The Participant confirms his/her age of majority in the application form and can give consent to the use of their image by the Service Provider (including marketing purposes). Participants image (including photos, videos and portraits) may be used and distributed in the press, occasional publications, brochures, electronic publications, websites, television and other media. 4. As part of the application form the Participant is entitled to declare any preferences regarding the types of meals consumed during the Training Camp, including in particular a desire to eat only vegan, vegetarian, gluten-free or not containing specific ingredients (including due to individual preferences or health reasons) or other types of meals. Failure to include the aforementioned information in the application form shall result in the Participant being provided with a standard menu, without the possibility of raising objections or changing preferences during the Training Camp.

5. By submitting the application form the Participant confirms that he/she is familiar with the Regulations and the information clause regarding personal data processing and undertakes to adhere to it.

6. After submitting the completed application form, participant’s application is pending for consideration by the Service Provider. Service Provider will check, as far as possible, the correctness and completeness of the data provided and confirm the possibility of participation in Training Camp or the need to complete the application within 7 days of sending the application.

7. Applications that are not approved by the Service Provider do not constitute a basis for a contractual relationship between the applicant and the Service Provider and are not considered an effective application. Service Provider shall send confirmation of the application to the Participant in a document form, to the e-mail address indicated by the Participant.

IV. TRAINING CAMP

1. Training Camp will be held in Poland, in Minsk Mazowiecki.

2. Training activities during the Training Camp will be held in an indoor facility in Minsk Mazowiecki at MOSiR Mińsk Mazowiecki, Wyszyńskiego 56, 05-300 Mińsk Mazowiecki, Poland.

3. Activities during the Training Camp will be conducted in English. Knowledge of English on at least communicative level is not required to participate in the Training Camp, however it is necessary to acquire knowledge in the course of training.

4. The Training Camp shall be held from 20.04.2023, starting at 8:00 AM, until 23.04.2023 at 6:00 PM 

5. During the Training Camp specialists in the field of teaching roller skating will conduct theoretical and practical instructions on conducting roller skating training. The course is dedicated for roller skating instructors who want to improve their abilities in teaching roller skating, not for roller skating students who want to learn how to roller skate.

6. During the Training Camp there can be conducted both theoretical and practical classes, requiring participants to skate.

7. Service Provider will provide three nights accommodation during the Training Camp in ELITMAT Apartments, Stefana Okrzei 7 Street, 05-300 – Minsk Mazowiecki, run by Dariusz Kulma conducting business under the name Firma Edukacyjno-Wydawnicza ELITMAT DARIUSZ KULMA, NIP: 8221072060, REGON: 140706036 (website: http://www.apartamenty.elitmat.pl/).

8. The Service Provider shall provide meals for the duration of the Training Camp in the form of three meals per day: breakfast, lunch and dinner. Meals will be organized for the entire group of participants together, at times determined by the Service Provider during the training

9. Participants are required to use their own skating equipment during the Training Camp, including individually fitted roller skates and helmet.

10. Participants are required to obey and follow the instructions of instructors, obey the mandatory laws and rules applicable at the hotel and place of training, attend the training in a state of sobriety (free from influence of any psychoactive substances), refrain from behavior endangering the life or health of any of the Participants or third parties.

11. The Service Provider shall inform the Participants of the planned schedule for the next day at the latest 1 day before each consecutive day of the Training Camp. Participant’s failure to appear in places and times designated by the Service Provider may result in inability to participate in the activities.

V. PRICE

1. The total price for the participation in Training Camp is: 1499 EURO;

2. Participant is obliged to make an advance payment to Service Provider in the amount of 300 EURO, no later than within 3 days from confirmation of registration by the Service Provider. The advance payment is credited in full to the price referred to in paragraph 1 above.

3. Failure to pay the advance payment by the Participant within the deadline expires his/her application for participation in the Training Camp and releases the place occupied by the Participant.

4. In the event of a Participant’s resignation from the Training Camp, the advance payment shall not be returned to the Participant.

5. The remaining part of the price not covered by the advance payment shall be paid by the Participant on the day of the Training Camp at the latest by bank transfer or in cash.

VI. ADDITIONAL PROVISIONS

1. Service Provider shall not be liable for any damage caused by the Participant during the Training Camp. The participant is obliged to compensate for any damage caused by their behavior to third parties, including in particular accommodation providers, if there are prerequisites for the Participant’s liability for damages.

2. Participant is obliged to compensate for any damage caused to the Service Provider through the fault of the Participant or arising in connection with the Participant’s failure to comply with the Regulations or instructions of persons conducting training.

3. Training Camp is addressed to healthy and physically fit people, and the Service Recipients participate in the training at their own risk. Service Provider shall not be liable for damages incurred by the Participant through no fault of the Service Provider or entities subject to its management, in particular for damages arising from reckless skating during the Training Camp or due to health defects of the Participant.

4. Service Provider does not provide safekeeping of the things taken by the Participants to the Training Camp and is not responsible for their loss or damage.

5. The Service Provider does not organize the entire duration of the Training Camp and Participants will be given free time to use at their own discretion. The Service Provider shall not be liable for any acts or omissions of the Participants or any damage suffered or caused by the Participants during their free time. If the Participant does not participate in activities organized by the Service Provider, the provisions of this paragraph shall apply accordingly.

6. The Participant shall plan, organise and carry out his/her own travel from his/her place of residence to the Training Camp and back. Service Provider shall not provide transportation or cover the cost of tickets covering transportation from Participant’s place of stay to Training Camp or from Training Camp to Participant’s place of stay. Service Provider also does not provide or support the process of obtaining any documents legalizing the Participant’s entry and stay in Poland.

7. The Parties are not responsible for events resulting from force majeure, understood as extraordinary factual circumstances that affect the possibility of proper or safe implementation of the contract between the Parties. Force majeure events are considered to be, in particular, strikes, wars, natural disasters and epidemics of infectious diseases.

8. In the case of inability to organize a Training Camp at the originally indicated date due to force majeure events, in particular due to the SARS-CoV-2 virus pandemic and restrictions related to this virus, or conducting military operations that may threaten the Participants in the place of conducting the Training Camp, Service Provider shall – according to circumstances – offer the Participant another date of Training Camp or cancel the event, and the Service Recipient may participate in the Training Camp at a new date or claim reimbursement of the advance payment.

VII. COMPLAINTS

1. Clients have the right to lodge a complaint regarding services provided by the Service Provider. Complaints should be submitted electronically to the e-mail address info@iloverolki-iic.com or reported directly to the Service Provider during the Training Camp.

2. In the complaint, the Service Recipient is required to provide his contact details to enable contact and present his request.

3. If necessary, the Service Provider may request the Client to complete the claim with information or documentation necessary for proper consideration of the complaint. Service Recipient shall complete the complaint with the indicated deficiencies within 3 working days. If the complaint is not completed within the time limit, the service provider will consider the complaint based on the facts and documents presented in the complaint.

4. Service Recipient is obliged to indicate in the complaint non-compliance of services with the contract and evidence to support their claims.

5. The Service Provider will consider a complete complaint within 7 days from the date of complaint. The Service Provider shall immediately inform the Client about the decision.

6. In the result of considering the complaint Service Provider may decide, in particular, to refund part of the price paid by the Participant or to cover the costs incurred through the fault of the Service Provider.

VIII. INFORMATION FOR CONSUMERS

1. The Service Provider informs that pursuant to Article 38 paragraph 12 of the Consumer Rights Act (ustawa o prawach konsumenta), you have no right to withdraw from the remote agreement.

2. The Participant has the following examples of out-of-court methods of dealing with complaints and claims:

  • a request for dispute resolution to a permanent amicable consumer court (more information at: http://www.spsk.wiih.org.pl);
  • application for out-of-court dispute resolution to the provincial inspector of the Trade Inspection (more information at: https://katowice.wiih.gov.pl/p,163,spory-konsumenckie);
  • assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection).

3. The website http://ec.europa.eu/consumers/odr provides information about the system for resolving disputes involving consumers in relations with entities from the European Union. The aforementioned platform is an interactive and multilingual website dedicated to consumers and entrepreneurs seeking an out-of-court settlement of a dispute concerning contractual obligations arising from an online sales contract or service contract.

IX. FINAL PROVISIONS

1. The law applicable to the concluded contract for the provision of services for the organization and participation in the Training Camp is the law of the Republic of Poland.

2. The competent courts for disputes arising under the contract between the Service Provider and the Participant are common courts located in the Republic of Poland.

3. If it is determined that any of the provisions of the Regulations is legally invalid or ineffective, this circumstance will not affect the validity and effectiveness of the remaining provisions.
